Presidential Decree 412/93 defines "energy service contract" as the contractual act governing the provision of goods and services necessary to maintain comfort conditions in buildings while providing for the improvement of the energy transformation and utilization process. Reducing energy costs, in fact, must be accompanied by appropriate strategies for the operation and maintenance of facilities and the provision of energy for their operation. This includes the Energy Service Company (ESCo), which can provide: fuel or electricity purchase, operation and maintenance of production systems, monitoring of energy produced, consumption reporting, and upgrading of building-plant systems. The opportunities related to this type of convention are growing both in terms of public calls for tenders and requests from private organizations, also in view of the achievement of the European 2030 energy efficiency targets.

Energy Service

What is energy service?

An energy service contract represents an agreement between a company active in the provision of energy services (ESCo) and a beneficiary entity, whether a public administration, business or other private organization. The ESCo takes responsibility for the facilities installed at the beneficiary’s facilities and provides all the necessary services (energy to power them, operation and maintenance services, monitoring and control of consumption) combined with the implementation of energy upgrades; in return it receives a fee from the client. Upgrades enable the ESCo to reduce energy supply costs for the contract period and make a profit. At the end of the contract, the client will remain the sole beneficiary of the improved energy performance of its facilities.

What are the regulatory references for the energy service contract?

The energy service contract is defined by Legislative Decree 115/2008, which distinguishes between energy service contract and energy service contract Plus. The latter, in addition to the characteristics of the energy service contract, must necessarily include the reduction of the primary energy index for winter air conditioning by at least 10 percent compared to the value before work and by 5 percent for any subsequent contracts, the installation of thermoregulation systems and automatic room temperature control, where technically feasible.

Who does an energy service contract address?

The energy service is primarily aimed at facilities characterized by a large building stock consisting of centralized facilities and widespread energy use, such as schools, hospitals, apartment buildings, shopping centers, public and private offices, and industrial plants. In accordance with Legislative Decree 115/2008, among the contracts that can be proposed as part of the provision of an energy service to public administrations is the energy service contract.
